These terms and conditions (the “Terms and Conditions”) govern the use of headlice.thence.us (the “Webzine”). This Webzine is owned and operated by THENCE LLC. This Webzine is an e-learning publication for demonstration purposes.

By using this Webzine, you indicate that you have read and understand these Terms and Conditions and agree to abide by them at all times.

1.2 Intellectual Property
All content published and made available on our Webzine is the property of THENCE LLC and the Webzine’s creators. This includes, but is not limited to images, text, logos, documents, downloadable files and anything that contributes to the composition of our Webzine.

1.3 Age Restrictions
The minimum age to use our Webzine is 18 years old. By using this Webzine, users agree that they are over 18 years old. We do not assume any legal responsibility for false statements about age.

1.4 Acceptable Use
As a user of our Webzine, you agree to use our Webzine legally, not to use our Webzine for illegal purposes, and not to:

  • Harass or mistreat other users of our Webzine;
  • Violate the rights of other users of our Webzine;
  • Violate the intellectual property rights of the Webzine owners or any third party to the Webzine;

Our Webzine may offer goods and services from third parties. We cannot guarantee the quality or accuracy of goods and services made available by third parties on our Site.

THENCE LLC and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities and expenses including legal fees from your use of the Webzine.

Except where prohibited by law, by using this Webzine you indemnify and hold harmless THENCE LLC and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of our Webzine or your violation of these Terms and Conditions.

1.8 Applicable Law
These Terms and Conditions are governed by the laws of the United States, and specifically for the State of New Jersey, and Michigan. Additional information about European Union’s General Data Protection Regulation (GDPR) compliance can be found in Privacy Policy Part II.

1.9 Additional Terms

As an educational company website we learn from the way you learn. That means that when you complete the interactive portion of the video you are also showing us your recall of information, how you analyze information, and how you think about this information. 1.9.1 Severability
If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.

1.9.2 Changes
These Terms and Conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate our Site and the way we expect users to behave on our Site. We will notify users by email of changes to these Terms and Conditions or post a notice on our Site.

3. HOW LONG DO WE STORE YOUR DATA?

We do not store any personal data longer than strictly necessary.

3.2 Storage of non-personal data. We retain non-personal data pertaining to you for as long as necessary for the purposes described in this Privacy Policy. This may include storing non-personal data for the period of time needed for us to examine our activities, fulfil our contractual obligations, pursue our legitimate interests, conduct audits, comply with (and demonstrate compliance with) legal obligations, resolve disputes and enforce our agreements.

3.3 Storage as required by law. In very seldom cases, we may be obliged by law to store your personal data for a certain period of time. If such a requirement exists, we will store your personal data for the time period stipulated by the applicable law and delete the personal data as soon as the required retention period expires.

4.1 Disclosure to data processors. We keep your personal data in strict confidentiality. However, if necessary for the intended purpose of your personal data, we will disclose your personal data to entities that provide services on our behalf (our data processors). Your personal data may be shared with entities that provide technical support services to us, such as hosting, payment processing, and email distribution services. We do not sell your personal data to third parties and do not intend to do so in the future. The disclosure of your personal data is limited to the situations when it is required for the following purposes:

  • Ensuring the proper operation of the THENCE Webzine;

  • Pursuing our legitimate interests;

  • Our CRM service provider Zoho (https://www.zoho.com/) located in India;
  • Our business management software service provider Odoo (https://www.odoo.com/) located in Belgium;
  • Our analytics service provider Google Analytics (https://analytics.google.com) located in the United States; and
  • Our independent contractors and consultants.

4.3 International transfers. Some of our data processors may be based outside the country where you reside.For example, if you reside in a country belonging to the European Economic Area (EEA), we may need to transfer your personal data outside the EEA. In case it is necessary to make such a transfer, we will make sure that the country in which our data processor is located guarantees an adequate level of protection for your personal data or we conclude an agreement with it that ensures such protection (e.g., a data processing agreement based pre-approved Standard Contractual Clauses).

4.4 Disclosure of non-personal data. Your non-personal data may be disclosed to third parties for any purpose as it does not identify you as a natural person. For example, we may share it with prospects or partners for business or research purposes, for improving the THENCE Webzine, responding to lawful requests from public authorities or developing new products and services.

4.5 Legal requests. If requested by a public authority, we will disclose information about the users of the THENCE Webzine to the extent necessary for pursuing a public interest objective, such as national security or law enforcement.

5. HOW DO WE PROTECT YOUR DATA?

The security measures taken by us include secure Swiss servers, encryption, proper authentication, secured networks, strong passwords, limited access to your personal data by our staff, anonymization of personal data (when possible), and carefully selected data processors.

5.2 Security breaches. Although we put our best efforts to protect your personal data, given the nature of communication and information processing technology and the Internet, we cannot be liable for any unlawful destruction, loss, use, copying, modification, leakage, and falsification of your personal data caused by circumstances that are beyond our reasonable control. In case a serious breach occurs, we will take reasonable measures to mitigate the breach, as required by the applicable law. Our liability for any security breach will be limited to the highest extent permitted by the applicable law.

6.2 How to exercise your rights? If you would like to exercise any of your legitimate rights, please contact us by using our contact details available at the end of the Privacy Policy and explain in detail your request. In order to verify the legitimacy of your request, we may ask you to provide us with an identifying piece of information, so that we can identify you in our system. We will answer your request within a reasonable time frame but no later than 30 days.

6.3 Complaints. If you would like to launch a complaint about the way in which we handle your personal data, we kindly ask you to contact us first and express your concerns. After you contact us, we will investigate your complaint and provide you with our response as soon as possible (no later than 30 days). If you are not satisfied with the outcome of your complaint, you have the right to lodge a complaint with your local data protection authority.

7. COOKIES AND ADVERTISING

7.1 We use cookies on the THENCE Webzine in order to analyze the technical aspects of your use of the THENCE Webzine, conduct our marketing campaigns, prevent fraud and abuse, and ensure the security of the THENCE Webzine. The legal bases on which we rely are ‘pursuing our legitimate interests’ (i.e., analyze our content and protect the THENCE Webzine) and ‘your consent’.
